PLAYSONGSPARTY Terms

Article 1 (Purpose)

The purpose of these Terms and Conditions is to set forth the rights of the Company and users in using the PlaySongSparty service operated by Bicycle Corporation (hereinafter referred to as the 'Company') and the conditions, procedures, responsibilities, and other matters necessary for the use of the service.

Article 2 (Definitions)

As used in these Terms, the following terms have the following definitions

Article 3 (Provision of 'Company' Information, etc.)

The Company shall post the contents of these Terms, its name, name of representative, business address (including the address of the place where consumer complaints can be handled), telephone number, e-mail address, business license number, and mail-order business registration number on the initial screen of the Application (hereinafter referred to as the "App Page") so that users can easily recognize them. However, some related contents may be made available to the 'User' through the connection screen.

Article 4 (Amendments to Terms, etc.)

1.'Company' may amend these Terms and Conditions to the extent that it does not violate applicable laws such as the Act on Consumer Protection in Electronic Commerce, etc. and the Act on Regulation of Terms and Conditions.
2. If the 'Company' revises the Terms, it shall notify the 'App Page' with the current Terms, specifying the date of application and the reason for revision, at least 15 days before the date of application. However, if the contents of the Terms are changed to the disadvantage of the 'User', it shall be notified 30 days before the effective date.
3. If the 'Company' notifies the 'User' of the change of the Terms pursuant to Paragraph 2 and the 'User' does not indicate his/her refusal by the effective date of the change of the Terms, the 'Company' shall be deemed to have agreed to the change of the Terms, and the 'User' does not expressly indicate his/her refusal to the change of the Terms, the 'Company' shall be deemed to have agreed to the change of the Terms.
4. 'User' may stop using the Service and terminate the Use Agreement if he/she does not agree to the Terms of Change in Paragraph 3.

section 5 (interpretation of terms)

Matters not provided for in these Terms and the interpretation of these Terms shall be governed by the Act on the Regulation of Terms and Conditions, the Act on Consumer Protection in Electronic Commerce, the Content User Protection Guidelines, and other relevant laws and regulations or common practice.

Article 6 (User Access)

1. Subscription to the 'Service' is deemed to be a subscription to the 'Service' when the 'User' agrees to the contents of these Terms and Conditions through the 'Application' and concludes a paid service.
2. 'Company' may restrict the use of the Service in any of the following cases.
A. If the person whose use contract has been terminated due to failure to pay the 'Service' fee to the 'Company' does not pay the overdue fee
B. You are unpaid or delinquent on your carrier bill
C. "If you are registered in default information (including if you are registered as a defaulter of telecommunication charges), public record information, financial order disorder information, etc. in accordance with the Act on the Use and Protection of Credit Information, the Credit Information Management Regulations of Credit Information Aggregation Agencies, the Common Credit Information Management Regulations of Credit Information Companies, etc.
l. You don't have the capacity or the technology to provide the "service
E. Using the 'Service' for fraudulent purposes
b. If it is difficult to approve the application for use for reasons falling under any of the above items
3. If the User subscription is not concluded pursuant to Paragraph 2, the Company shall notify the Applicant. However, exceptions shall be made if the Company is unable to notify the applicant without any reason attributable to the Company.

Article 7 (Special Rules for Users Under the Age of 14)

1. The 'Company' must obtain the consent of a legal representative such as a parent to collect, use, and provide personal information from a 'User' under the age of 14. In this case, the 'Company' may require the 'User' to provide minimum information such as the name of the legal representative in order to obtain the consent of the legal representative.
2. 'Company' shall cancel or deny subscription to 'Users' under the age of 14 who have not gone through the confirmation procedure for the consent of legal representatives such as parents.
3. Parents or legal representatives of 'Users' under the age of 14 may request to view, correct, or update the personal information of 'Users' under the age of 14 or withdraw their consent to the subscription, and in such cases, the 'Company' shall take necessary measures without delay.

section 10 (notices to 'users')

1. When the 'Company' notifies the 'User', it may do so by using the e-mail address, mobile phone, or other appropriate communication method designated by the 'User'. However, if the User provides inaccurate information, or if the User's contact information is not provided and individual notification is difficult, the Company may substitute notification to the User through methods such as pop-ups on the App page.
2. The Company may substitute the notice in Paragraph 1 by posting it on the 'App Page' bulletin board for a substantial period of time in the case of notice to all 'Users'.

Article 11 (Withdrawal of Users and Disqualification, etc.)

1. Users can stop using the Service by unsubscribing from the App Store.
2. If the 'User' falls under any of the following reasons, the 'Company' may restrict or suspend the 'Service' user status.
A. Failure to fulfill the 'Service' usage fee or other debts incurred by the 'User' in connection with the use of the 'Service' of the 'Company' on the due date.
B. Engage in any act that violates the law, or any act prohibited by these Terms or contrary to public order and morals
3. If the 'Company' restricts or suspends the 'User' qualification, and the same behavior is repeated more than twice or the reason is not corrected within 30 days, the 'Company' may disqualify the 'User' from using the 'Service'.
4. If the Company disqualifies itself under the preceding paragraph, it shall terminate the User's registration. In this case, the Company shall notify the User and give the User a period of at least 30 days to make a defense before terminating the User's registration.

Article 12 (Posting of 'Content' Content, etc.)

Article 13 (How to Use the Content)

1. 'User' shall apply for use by the following or similar procedures provided by 'Company'.
A. Viewing and selecting from the 'Content' list
B. Check and agree to the contents, fees, and terms of use of the 'Content'
C. Confirmation of your request
2. The'Company' may refuse to accept or withdraw the acceptance of the application for use if the application for use of the'User' falls under any of the following subparagraphs.
A. The facility's capacity to provide the Service is insufficient, or there are technical or business problems.
B. Other reasons falling under any of the preceding paragraphs for good cause.
3. The 'Content' use contract is deemed to be established when the 'Company's' consent reaches the 'User'.
4. 'Users' may use 'Contents' in accordance with the conditions and contents set forth in the paid 'Service' product to which they have subscribed.
5. the Service and all Content provided through the Service are for your personal, non-commercial use only, and the Company grants you a limited, non-exclusive, non-transferable right to use the Content in accordance with the terms and conditions of these Terms and the individual Terms, and no right, title or interest is transferred to you except as provided herein.

Article 14 (Special Rules for Minors)

If a minor under the age of 19 wishes to use the paid 'Service', the 'Company' shall obtain the consent of a legal representative such as a parent or legal representative, or take measures to notify the minor before concluding the contract that the minor or his/her legal representative may cancel the contract if the consent is not obtained after concluding the contract.

Article 15 (Obligations of the 'Company')

1. The 'Company' shall exercise the rights and fulfill the obligations set forth in the laws and these Terms and Conditions in good faith.
2. 'Company' shall have a security system to protect personal information (including credit information) so that 'Users' can use 'Contents' safely, and shall disclose and comply with the Privacy Policy. However, the Company's privacy policy does not apply to linked sites other than the Company's official site, and the Company shall not be liable for any accidents such as personal information leakage caused by the User's fault.
3. 'Company' shall take measures to allow 'User' to check the use of 'Content' and the payment details from time to time.
4. If the Company recognizes that the opinions or complaints raised by the User in relation to the use of the Content are justified, the Company shall handle them without delay. For opinions or complaints raised by the User, the Company shall communicate the process and results of the process through the 'App Page' bulletin board, e-mail, or wired telephone.
5. The Company shall compensate the User for any damages suffered by the User due to the violation of the obligations set forth in these Terms.
6. In the event of a failure of the system for providing the Service, the Company shall promptly repair the failure. However, in the event of natural disasters, emergencies, or other unavoidable circumstances, the 'Service' may be suspended, in which case the 'Company' shall be exempt from liability for damages.

Article 16 (Obligations of the 'User')

1. you must not do any of the following
A. Stealing someone else's information
B. Transmitting or posting information (computer programs, etc.) that is prohibited by the Company
C. Infringement of intellectual property rights, including copyrights, of the Company and other third parties.
D. Using the 'Contents' provided by the 'Company' in a scope beyond private use, such as for public reproduction in public places and commercially oriented business sites, stores, etc.
E. Other illegal or unfair behavior
2. The 'User' shall comply with the relevant laws and regulations, the provisions of these Terms and Conditions, the precautions notified in connection with the User Guide and the 'Contents', and the matters notified by the 'Company', and shall not engage in any other acts that interfere with the 'Company's' business.

Article 17 (Program Installation and Data Collection)

1. The 'Company' may require the 'User' to install the 'Application' and separate programs if necessary to provide the 'Service', and the 'User' may refuse to install the 'Application' if the 'User' does not want to. However, if the 'User' refuses to install the 'Application' and separate programs, the use of the 'Service' may be restricted.
2. The 'Company' may collect and use the 'User's' data on the use of the 'Service' through the 'User's' terminal device, etc. and the 'User's' information necessary for the provision of the 'Service'.
3. The Company shall use the data in the preceding paragraph only for the purpose of providing and improving the Service, and providing the Service or technology suitable for the User's use environment, and shall not use it for any other purpose.
4. 'Company' shall go through the consent or notification procedure in accordance with relevant laws and regulations for program installation and data collection under this Article.

section 18 (provision and discontinuance of the 'services')

1. "Service" is intended to be available 24 hours a day, 7 days a week, 365 days a year.
2. 'Company' may temporarily limit or discontinue all or part of the 'Service' in any of the following cases.
A. In the event of maintenance, inspection, replacement, or breakdown of information and communication facilities such as computers, interruption of communication, etc.
B. Unavoidable due to construction, such as maintenance of facilities for 'Services'
C. There are force majeure reasons such as natural disasters, national emergencies, etc.
D. If the Company is no longer able to provide the Service due to changes in the Company's business plan or management reasons
E. "When a telecommunications service provider stipulated in the Telecommunications Business Act stops telecommunications services
3. In the event of any restriction or suspension of the 'Service' pursuant to the preceding Paragraph, the 'Company' shall notify the 'User' in the manner set forth in Article 10 [Notification to the 'User']. However, if there is an unavoidable reason that the'Company' cannot notify in advance, it may notify afterward.
4. the availability of the Content may be partially restricted at the request of the provider or copyright holder supplying the Content, and the availability of the Content may be restricted if you are accessing it from abroad.
5. The Company may conduct regular inspections when necessary to provide the Service, and may temporarily suspend the provision of the Service during regular inspections. The periodic inspection time is as announced on the 'Service' provision screen.

section 19 (duration and termination of the services)

1. The period of use of the Service by the User shall be from the date of application for the Service to the termination of the Service Use Agreement.
2. 'Company' may limit or suspend the provision of the 'Service' if it is unable to provide the 'Service' due to natural disasters or equivalent force majeure.
3. The 'Company' may restrict or suspend all or part of the 'Service' if any of the following reasons occur to the 'User'.
A. If the User violates the User's obligations under these Terms
B. You are delinquent in paying for the Service more than once.
C. Violate any other applicable laws, etc.
4. When the'Company' intends to restrict or suspend the use of the'Service' pursuant to Paragraphs 2 and 3, it shall notify the'User' by specifying the reason, date, and period. However, if the 'Company' recognizes that it is necessary to restrict or suspend the use of the 'Service' urgently, it may notify the 'User' after restricting or suspending the use of the 'Service', and if it cannot be notified due to reasons not attributable to the 'Company', it shall be deemed to have been notified by posting on the 'App Page'.
5. If the 'Company' intends to temporarily suspend the provision of the 'Service' due to unavoidable reasons that the 'Service' cannot be provided, such as system improvement work, equipment expansion, or regular inspection, the 'Company' shall specify the reason and suspension period in advance on the 'App Page' and notify the 'User' or his/her representative via telephone, fax, e-mail, visit, mail, etc. However, this shall not apply if the 'Company' recognizes that it is necessary to stop using the 'Service' urgently or if the 'User' cannot be notified due to reasons attributable to the 'User'.

section 20 (termination of the 'service')

If the Company becomes unable to provide the Service for reasons such as switching business items, abandoning the business, or other management judgment, the Company may terminate the Service by notifying the User 60 days prior to the scheduled date of termination of the Service.

section 21 (changes to the 'services')

The 'Company' may change the 'Service' provided in accordance with operational and technical needs if there is a substantial reason, and in this case, the 'Company' shall notify the 'User' of the contents of the 'Service' to be changed and the date of provision in accordance with Article 10 [Notification to the 'User'], and Article 10.2 shall apply to this.

Article 22 (Provision of Information and Placement of Advertisements)

1. The 'Company' may send information and advertisements related to the provision and operation of the 'Service' through methods such as APP push to 'Users' who have agreed to the transmission of commercial information for commercial purposes. However, the 'User' may refuse to receive the above information or advertisements at any time through the unsubscribe method provided by the 'Company' to the 'User'.
2. 'Company' may provide 'User' with information and advertisements related to the provision and operation of 'Service' through 'App Page' or 'Service' screen.
3. The Company shall not be liable for any loss or damage arising from the User's participation in the Advertiser's promotional activities through the advertisements posted pursuant to the preceding paragraph or as a result of any communication or transaction.

Article 24 (Attribution of Copyrights, etc.)

1. Copyrights and other intellectual property rights to posts created by the Company belong to the Company.
2. The intellectual property rights of the data collected in the course of the Company's operation of the Service shall belong to the Company.
3. Copyrights and other intellectual property rights to works provided under the partnership agreement among the 'Services' provided by the 'Company' shall belong to the 'Company' or its providers.
4. The 'User' shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use for commercial purposes any information obtained by using the 'Service' provided by the 'Company' that belongs to the intellectual property rights of the 'Company' or the 'Provider' without the prior consent of the 'Company' or the 'Provider', or cause the information to be used by a third party.
5. The Company shall obtain the permission of the User if it wishes to use the work such as posts created by the User.

Article 25 (Types of 'Service' Products and Fees, etc.)

1. The types of 'Service' products and, accordingly, the types of fees, etc. that the 'User' shall pay to the 'Company' for the use of the 'Service' are as follows [Appendix 1]. However, the fees may be discounted or not charged in the case of pilot service operation before the commencement of commercial service.
2. If the 'Service' fee changes in the middle of the month, it is calculated by multiplying the number of days of use up to the day before the fee change date of the month by one-half of the monthly fee before the change, and by multiplying the number of days of use from the change date to the end of the fee month by one-half of the changed monthly fee.
3. if the mobile plan or mobile package product is a dependent product, the terms and conditions of the product shall apply.
4. The Service fee is charged monthly in advance, and the User pays the Service fee by the payment method selected in accordance with Article 26.
However, in the case of a term ticket product, the payment will be charged monthly or in a lump sum depending on the payment method selected on the payment date.

Article 26 (Payment Method for Service Use)

The payment method for the 'Service' fee can be made through the app market payment (in-app payment) method. However, depending on the payment method, the user's payment amount may differ, and the Company may charge additional costs (fees, etc.) according to the user's payment method and payment institution along with the 'Service' fee.

Article 27 (Obligation to Pay Fees)

1. In principle, the obligation to pay the 'Service' usage fee is on the 'User' who has entered into a 'Service' usage contract with the 'Company'. However, if the 'Company' recognizes it, the 'User' may designate a third party as the person responsible for payment of the fee with the consent of the third party.
2. The person responsible for payment of fees pursuant to the provisions of Paragraph 1 shall be obligated to pay all debts such as fees owed by the 'User' to the 'Company' in solidarity with the 'User'.
If you change your billing contact, you must obtain the consent of the new billing contact, and you will be responsible for any outstanding charges owed by the previous billing contact.

Article 28 (Billing of Service Usage Fees)

1. 'Company' may charge the 'Service' usage fee in combination with the 'Company' mobile service usage fee. In this case, the billing and payment method of the 'Service' usage fee shall be subject to the billing and payment method in accordance with the 'Company's' mobile service terms and conditions.
2. The Company may charge any unpaid amounts and small charges below a certain amount to the last billing month's Service fee.
3. 'Company' may have the person in charge of paying the fee make a lump sum payment by centralized payment (which refers to a lump sum payment made by a higher authority or a main business or office) if recognized by a national institution, local government, foreign institution in Korea, or other 'Company'.
4. The Company may integrate and charge the Service usage fee with the service usage fee when the User uses other services of the Company, and may integrate and charge the fees for services provided by other companies through the Service.
5. The 'Company' shall notify the 'User' who is in arrears of the 'Service' usage fee in the manner prescribed by the 'Company'.
6. The Company may delegate billing, collection, and non-payment reminders to other companies. However, if there is a significant change in the delegation, the Company will notify you separately.

Article 29 (Payment of Fees)

1. The person responsible for payment of charges under this Chapter shall pay the amount of charges such as fees stipulated in the Terms and Conditions by the due date.
2. Users may change the payment method according to the method specified by the Company, such as application through the application and customer center. However, the 'Company' shall charge according to the changed payment method from the month following the month of application for change, and if the payment method is specified according to the contents of the 'Service' or if there is a separate notice, it shall be followed.
3. The due date for payment of fees, etc. under this Chapter shall be the date set by the Company, and a notice of change in the due date shall be posted on the App Page one month before the due date.

Article 30 (Imposition of Surcharge)

1. If the person responsible for paying the fee under this Chapter does not pay the 'Service' fee by the due date specified by the 'Company', the 'Company' shall charge an additional fee according to the following formula.
Surcharge = unpaid charges (including VAT) x days late x late penalty rate (2/1,000)
2. The surcharge under paragraph 1 shall be charged and collected together with the fee for the Service.
3. 'Company' shall not charge a surcharge if it is recognized that the payment request has not been submitted to the person responsible for payment by the due date.

Article 31 (Appeal of Charges)

1. The 'User' may file an appeal to the 'Company' within 6 months from the date of receipt of the charge if there is any objection to the charge. However, if an overpayment occurs due to the Company's fault, the User may file an appeal regardless of the text.
2. The Company shall investigate the validity of the appeal and notify the User or his/her representative of the result within 10 days after receipt of the appeal, and if the Company is unable to notify the result of the appeal within the specified deadline due to unavoidable reasons, the Company shall notify the User specifying the reason and the redesignated processing deadline.
3. If you have paid by the Article 26 method, termination/refund/customer inquiries, etc. are subject to the applicable App Market Terms of Service policy.
- Apple App Store payments are subject to the policies in the "Apple Media Services Terms of Service".
- Google Play payments are subject to the policies in the "Google Play Terms of Service".

Article 32 (Return of Usage Fees, etc.)

1. The'Company' shall return the overpaid usage fee to the'User' if there is an overpayment of the usage fee, and if the overpayment occurs due to the'Company's fault, the'Company' shall add appropriate interest at the interest rate (see Article 30.1, Paragraph 1, at the same level as the rate at which the customer collects the surcharge). However, if the User agrees or does not respond to the Company's notice of return, the Company may offset the amount of the overpayment against the newly incurred Service fee.
2. The 'Company' may first reimburse and return the 'Service' usage fee, etc. if there is non-payment of the 'Service' usage fee, etc. to be returned.

Article 33 (Cancellation and Termination of Contract by 'User')

1. The User may cancel or terminate the Content Use Agreement within three (3) months from the date of receipt of the 'Content' or 'Service' product or within thirty (30) days from the date the User knew or could have known the fact in any of the following cases.
A. The 'Content' as promised in the Agreement is not provided
B. If the 'content' provided is different from or significantly different from the display or advertisement, etc.
C. Other defects in the "Content" that make normal use significantly impossible.
2. A 'User' who has applied for a 'Service' product may request the 'Company' to cancel payment (withdrawal of subscription) within 7 days from the payment date of the product, and the details of this are in accordance with [Appendix 1].
3. If the 'User' applies for withdrawal of the subscription after the period (within 7 days from the date of payment) during which the 'User' can withdraw the subscription for the product pursuant to Paragraph 2, or if the 'Content' falls under the reasons for the restriction on withdrawal of the subscription set forth in other related laws such as the Act on Consumer Protection in Electronic Commerce, the Content Industry Promotion Act, the Content User Protection Guidelines, etc.
4. Users who use mobile plans that include this 'Service' and dependent products of 'Package Products' can withdraw their subscription as stipulated in the terms and conditions of each product.
5. If the 'User' wishes to terminate or cancel the contract pursuant to Paragraph 1, he/she must apply directly through the app store.

Article 34 (Effect of Termination of Contract by User)

1. The 'Company' shall immediately stop providing the 'Service' and terminate it upon receipt of a termination application pursuant to the provisions of Article 33, Paragraph 5.
2. Notwithstanding the termination pursuant to the preceding paragraph, if the User's unpaid fees exist at the time of termination, the User shall be obligated to pay them in accordance with these Terms until they are paid in full.

Article 35 (Cancellation, Termination and Restriction of Use of the 'Company')

1. The 'Company' may cancel or terminate the contract with the 'User' without prior notice or restrict the use of the 'Service' for a specified period of time if the 'User' has engaged in the acts specified in Article 11, Paragraph 2 and Article 16, Paragraph 1, or at the request of related organizations such as the Korea Communications Commission.
2. The termination or revocation of Paragraph 1 shall be effective when the Company indicates its intention to the User in accordance with the method set forth in Article 10 [Notification to the User].
3. The 'User' may appeal against the 'Company's' cancellation, termination, and restriction of use in accordance with the procedures established by the 'Company'. If the 'Company' recognizes that the objection is justified, the 'Company' shall immediately resume the use of the 'Service'.

Article 36 (Company's obligation to compensate for damages, etc.)

1. The 'Company' shall compensate the 'User' for damages in the event that the 'Service' is suspended for more than 3 consecutive hours from the time the 'User' notifies the 'Company' of the fact that the 'Service' is not available for reasons not attributable to the 'User' (or when the 'Company' becomes aware of the fact before that time), and if the cumulative time of service failure exceeds 12 hours per month (from the first day of the month to the last day of the month), the 'Company' shall compensate the 'User' for damages in the amount of 3 times the amount of the fee corresponding to the period during which the service was not available, up to a maximum limit by mutual agreement. However, the total amount of damages shall not exceed the service fee for one month.
2. The amount of damages under Paragraph 1 shall be an amount equal to three times the average daily amount of the Service usage fee for the last three months (if less than three months, the applicable period shall apply), including the paid purchased Content, divided by 24, multiplied by the average hourly amount multiplied by the number of unavailable hours, with a limit of three times the amount calculated by consulting with the User. In this case, if the number is less than one hour, it shall be one hour.
3. Notwithstanding the provisions of Paragraph 1, the Company may be exempted from liability for damages if it proves any of the following reasons.
A. The Company is severely disrupted due to an external breach
B. Due to force majeure, such as wartime, events, natural disaster or equivalent national emergency
C. If the 'Service' is not available due to damage to the terminal device, etc. caused by the 'User's' intent or negligence
D. If the 'Service' cannot be provided due to the 'User''s reasons, such as moving to an area where the 'Service' is not available.
4. The 'Company' is not responsible for the factuality, reliability, accuracy, etc. of information and materials posted or transmitted by the 'User' in connection with the 'Service'.
5. The 'Company' shall not be liable for any personal expenses or damages incurred by the 'User' in the process of using the 'Service'.
6. Even though the 'Company' has made sincere efforts to ensure the security and stability of the 'Service', the 'Company' shall not be liable for any damage caused by illegal acts such as hacking or virus distribution by third parties.
7. The 'Company' shall not be liable for any termination of the 'Service' pursuant to Article 20 or any failure of the 'Service' not attributable to the 'Company', any failure of transmission or posting, or any data error, omission, omission, loss, destruction, corruption, etc. occurring in the process of using the 'Service'.
8. The Company shall not be responsible for the content and quality of any products or services advertised through the Service, nor shall it be liable for any transactions between Users or between Users and third parties utilizing the Service, nor shall it be obligated to monitor such transactions.
9. The Company shall not be liable for any problems arising in connection with the use of the Services provided free of charge, unless otherwise provided by applicable laws.
10. If the User makes a claim for damages to the Company, the User shall submit the claim in writing, stating the reason for the claim, the amount of the claim, etc.

Article 37 (Compensation for User Damages Due to Defects in Content)

1. The Company shall handle matters related to the standards, scope, methods, and procedures for compensating users for damages caused by defects in the Content in accordance with the Content User Protection Guidelines.
2. This Article shall apply first to compensation for user damages caused by defective content.

Article 38 (User's obligation to compensate for damages)

1. If the 'User' causes damage to the 'Company' or a third party (including other users) due to the 'User's' violation of the provisions of these Terms, the 'User' shall compensate the 'Company' or the third party for all damages incurred.
2. If a third party who suffers damages due to the illegal acts of the 'User' or violation of these Terms and Conditions claims damages against the 'Company', the 'User' shall indemnify the 'Company' at his/her own risk and expense, and if the 'Company' is not indemnified, the 'User' shall compensate the 'Company' for all damages caused to the 'Company' as a result.
3. This Article shall continue to be effective even after the 'User' terminates the 'Service' use contract by itself or the 'Company' suspends the use based on these Terms.
4. If the 'User' receives a refund even though it is not eligible for a refund, such as by illegally using the app market payment (in-app payment) policy even though it is not based on laws and regulations, the 'Company' may charge the 'User' for the amount of the refund that the 'User' received unfairly.

Article 39 (Disclaimers)

1. 'Company' shall be exempted from liability for providing 'Services' if it is unable to provide 'Services' due to the reasons in Article 18.2.
2. 'Company' shall not be liable for any failure to use the 'Service' due to reasons attributable to the 'User'.
3. The Company is not responsible for the reliability, accuracy, or other content of information, materials, or facts posted by Users in connection with the Content or Services.
4. The Company shall not be liable for any disputes between Users or between Users and third parties mediated through the Content.
5. the provision of the Contents may be partially restricted due to the request of the provider or copyright holder supplying the Contents, and the Company shall not be liable for any damage to the User caused by the restriction of the provision of the Contents.
6. When external services (shopping, weather information, play information services, etc.) are linked through the 'Service', the 'Company' only intermediates between the 'User' and each external service, and the 'Company' is not responsible for any damage caused to the 'User' due to the use of external services.

Section 40 (Resolution of Disputes)

1. The'Company' shall take appropriate and prompt measures in response to legitimate opinions or complaints raised by the'User' in the event of a dispute. However, if it is difficult to process quickly, the'Company' shall notify the'User' of the reason and the processing schedule.
2. Matters not specified in these Terms and Conditions shall be governed by the Commercial Act, the Telecommunications Business Act, the Act on Consumer Protection in Electronic Commerce, and other related laws and customs, and if a lawsuit is filed for a dispute arising from the use of the Service, the court of competent jurisdiction under the provisions of the Civil Procedure Act shall be the court of first instance.
